I think its an issue of morality not legality. Legally he is dead to rights. Not much of a leg to stand on.

Morally I think he does. As he says, He heard the presidents call to protect the country from WMD and stopping Alqueda. He joins and finds questionable agendas and misstated facts.

Being an American, fighting for freedom, responsible for action, trusting in God, all seem congruent with his saying he will not fight.

I don't think he should escape punishment for disobeying, I'm saying I respect his choice.
